Who Can Appeal A Parking Ticket?

The abolition of criminal penalties since 1990′s gave parking control to the local council rather than the police. Since then there has been a sharp increase in the amount parking tickets issued to motorists and it has led to an increase in appeals against these.

It is claimed by few sceptics and debaters that the reason behind such a vast and sudden increase in parking ticket appeal and issue since the days of decriminalisation is because of the local authorities and the subcontractors who collect the parking fines due to their significant interests in the increased revenue collection made indirectly through this parking fines. This theory also correlates with the year on year increase of parking ticket issue.

There are so many reasons for appealing parking tickets. The latest increase of parking fine has shot up to 120 pounds for some motorists.

A good idea would be to just go ahead and appeal your parking ticket if you think you did not have any fault. Chances are that the local council representative would not even turn up for the event and 50% motorists anyways win such appeals.

The fact is that if nobody is charged with parking tickets then there would be chaos on the roads and the local councils will have smaller budgets and they will be compelled to raise council taxes as there would be little or null revenues from parking fines.

While this is the theory of receiving a parking ticket and paying the parking fine, it can be safely stated that in reality the traffic wardens are under a lot of pressure to issue more and more tickets so as to boost local revenues.

So if you find somewhere to park and there are no signs to say it is okay you should avoid it as it likely to be a trap. You should avoid such places as you are likely to get a huge fine.

Appealing against a parking ticket is actually not very hard. Despite this fact 99% of people still pay their parking fine. All it usually takes is just one simple letter to the local councils or if even one is lucky enough then even more a compact email..even easier.

Is just sitting down and writing a quick letter for an appeal really too much hassle for you? Of course it is not! The major problem behind it is that common people do not even realise how easy it really is. There are also online companies who provide you with a template letter or even handles the whole appeal for you.

To ensure the parking appeal is successful, one needs to provide evidence that it is legally invalid. For instance provide a photograph showing that the offence in fact did not even occur as there were no signs displayed. With nearly two thirds of parking tickets being legally invalid you have a high chance of success.

Other than this usage of evidence gathered from photographs one can also use some technicality to aid in appealing a parking ticket. Generally a technicality involves something written on the parking ticket. For instance if you got a ticket which says you were parked in Smith Street when in fact you were parked in Smith Road then you could probably argue that it never occurred and you would win your parking ticket appeal.

Again there is yet another new phenomenon called private parking tickets. In this the ticket appears similar to what a traffic warden gives you only the distinction from normal ticket is it will say something like “Parking Charge Notice pay within 14 days for a reduced rate. Non payment will result in us contacting the D.V.L.A. for your details.”

However you can safely ignore these parking tickets. Do not even bother contacting the company. These tickets are illegal they are in fact only invoices. Just ignore any threatening letters as the company can not act on them.

To make my point more clear let me tell you one instance of a company called euro car parks where they have never taken anyone to court for non payment of parking fines.

As a general rule if any company seeks to take you into court over non payment, then they need to prove you as a registered keeper who was party to any contract (when you enter their car park you enter in to a contract). That is to say they need to show that you were driving the car at that time. Even if they prove that you were actually driving the car, they would only be entitled to the amount of 2 pounds for an extra parking hour.

To conclude you should not pay the parking ticket even if you receive 3 or 4 threatening letters from these private companies. Ignore them or even threaten them with a court order for harassment.

So you have a great chance of winning your parking ticket appeal. Do not pay without trying. For help and advice visit the website below.
